本文通过对西安市城中村现状及成因的分析,结合西安市目前城中村改造主要采用的政府主导、自我改造、开发商主导以及旅游开发区整体改造等模式。指出了改造实施过程中存在的资源浪费、资金匮乏、清产核算、安置补偿、景观文物保护等主要问题及其产生的原因,并且有针对性的提出了西安市城中村改造在立法政策配套、集约使用土地、多元改造方式、加快廉租解困房建设以及切实维护村民合法权益等方面的建议和对策。

Village inside City is a common phenomenon in the urbanization process in our country. It is also a special by-product along with the development of a city. Accompanied with the development of regional economy, city as its heart of politics, economy and culture, is continuously expanding. The fast expandsion resulted in lots of villages scattered in or being surrounded by city, which formed the Village inside City. However, as the pace of the city development speeds up, the situation of numerous villages inside city will badly affect the city image and hinder the function promotion and the unification development of city.
There exist several current reconstruction patterns for Villages inside Xi'an City. They include the government-leading pattern, under which, the government takes over the land, exploits, strategically packs and sells through marketing ways of bid, auction, self-reconstruction pattern, which means that, under the government's guide and support, the village collective or villagers collect funds and relocate themselves;real estate company-leading pattern, under which, all the reconstruction and relocation are led by the real estate dealers and the whole tourism development zone reconstruction pattern, which fully considers the protection of a historical city with cultural legacy and the sustainable development of the city so as to develop it into a tourism development zone combining with splendid cultures and dynamic vigor.
In the paper, the author analyzes the cause and the existing situation of Villages inside Xi'an City and points out the major problems and their reasons in the reconstruction process, such as waste of resources, insufficiency of funds, discharging of original assets, compensation for the relocation, and protection of the cultural relic, etc. Based on the analysis, authors puts forwards several proposals for the reconstruction strategy in the aspects of drafting out applicable laws, strengthening macroscopic planning, clarifying the assets vale of land, economizing the land use, exploring multi-reconstruction patterns, actively breaking the fund bottleneck, speeding up the construction of low-cost houses for rent and living as well as strictly prosecuting the illegal real estate exploitation so as to protect the rights and interests of people who live in the villages inside the Xi'an city.
In last few years, the reformation of Villages inside Xi'an City is being executed from all aspects after some experiments. In the process, there are normal modes learned from other places, also, some unique exploring. In the mean time, it also shows some new problems. How to calmly analyz and deal with these new problems, how to find a way to develop a new path which suits for the city, needs our ceaselessly exploring, accumulating, summarizing and perfecting as well.
